Affidavit Drafting Services Online in India
In short: An affidavit is a written statement of facts that you sign under oath or affirmation before a notary, magistrate, or oath commissioner, which is why banks, courts, universities, and government offices accept it as proof of something you cannot otherwise document. LegalDev drafts affidavits for name change, address, income, lost documents, and business use, and guides you through the correct stamp paper and notarization for your state.
You need an affidavit when nothing else in your file proves what you're trying to say: a name that changed after marriage, an address with no utility bill in your own name yet, a document that's gone missing. LegalDev prepares that written statement in the format your bank, college, or government office expects, so the stamp paper, the wording, and the notarization line up with what's actually required for your state and your purpose.

What Is an Affidavit?
An affidavit is a written statement of facts that the person making it, called the deponent, swears or affirms to be true, in front of someone legally authorised to take that oath. Once signed and attested, it carries real legal weight: knowingly putting false information in one can expose the deponent to prosecution for perjury under the Indian Penal Code provisions on false evidence.
Three things make an affidavit different from an ordinary letter or statement:
It is one-sided
Only the deponent's version of events appears in it, with nobody cross-examining the claim at the point it's signed.
It is sworn before an official
Most often a Notary Public appointed under the Notaries Act, 1952, though a magistrate, Oath Commissioner, or certain gazetted officers can also attest one depending on the purpose.
It is usually on stamp paper
Non-judicial stamp paper of a value fixed by the state where it's signed, because the Indian Stamp Act, 1899 and the state's own stamp schedule treat an affidavit as a chargeable instrument.
A self-declaration you write and sign yourself is not automatically an affidavit until an authorised official has administered the oath and attested it. Banks, universities, and passport offices ask for "an affidavit" specifically because they want that attestation step, not just your word.
Affidavit Services Offered by LegalDev
Every affidavit shares the same legal skeleton (deponent details, a sworn statement, and attestation), but the content, the supporting documents behind it, and sometimes the stamp value change with the purpose. LegalDev drafts the following categories:
Name Change Affidavit
Used when a name was recorded differently across documents: a spelling correction, a name taken on marriage, or a name changed after a formal gazette notification. States the old name, the new name, and the reason, and typically needs to be filed alongside (not instead of) a gazette publication where the authority requires one.

Address Proof Affidavit
For someone who has moved recently, or has no utility bill, rent agreement, or bank statement yet in their own name at the new address, and needs to declare their current residence for a bank, employer, or government form.

Identity Proof Affidavit
Used when a person needs to formally declare or confirm specific identity details, for instance confirming that two slightly different name spellings or two ID numbers belong to the same individual.

Income Affidavit
Required for scholarship applications, education loans, fee concessions, or college admissions where a declared family income needs to be formally sworn rather than just written on a form.

Lost Document Affidavit
Covers a lost PAN card, Aadhaar, passport, marksheet, or certificate. Typically states what was lost, roughly when and how, and that a police report or complaint (where required by the issuing authority) has been or will be filed, before a duplicate can be requested.

Marriage Affidavit
Supports marriage registration, visa applications, or joint-name updates on documents, and generally declares the date, place, and parties to the marriage, often alongside marriage photographs or an invitation card as corroborating evidence.

Gap Year Affidavit
For students applying to a course after a break in their education, explaining the gap years and confirming there's no disciplinary or other adverse reason behind the break, in the format the admitting institution asks for.

NOC Affidavit
A no-objection declaration: a family member confirming they have no objection to a property transaction, an employer confirming no objection to a side engagement, or similar consent-based statements an authority or institution requires in writing.

Legal Heir Affidavit
Used alongside a legal heir certificate or succession process, where surviving family members declare the relationship to the deceased and the list of legal heirs, which banks, pension offices, and property registries rely on before releasing assets or recording a transfer. Our legal heir documentation support covers both the certificate application and the accompanying affidavit.

Business and Company Affidavits
Covers LLP closure filings, where Rule 37 of the LLP Rules, 2008 requires an affidavit from the designated partners (confirming the LLP has not carried on business, or has settled its liabilities) alongside an indemnity bond, before Form 24 can be filed with the Registrar of Companies. Director-related declarations and other company compliance affidavits fall in the same category. Our LLP closure service prepares this affidavit and indemnity bond as part of the filing.

When Do You Need an Affidavit?
An affidavit typically gets asked for in these situations:
Passport, visa, or immigration documentation
Name change or correcting a name across official records
Bank account opening, loan processing, or KYC updates
Property, rental, or inheritance matters
School, college, or university admission
Court, police, or other legal proceedings
Government department applications
If you're not sure whether your situation genuinely needs a sworn affidavit or a simpler self-declaration will do, the authority asking for the document is the one to confirm with. Requirements differ by institution even for the same underlying situation.
Documents Required for Affidavit Preparation
Most affidavits need some version of the following, though the specific mix depends on the type:
Aadhaar card, PAN card, passport, or other valid government ID
A passport-size photograph, where the format calls for one
A clear account of the facts to be declared, in your own words, before drafting begins
Supporting documents relevant to the claim: old name proof for a name-change affidavit, income documents for an income affidavit, or a police complaint reference for a lost-document affidavit
Any specific format the receiving authority has prescribed, since banks, universities, and government departments sometimes supply their own template
Having these ready before you start cuts most of the back-and-forth out of the drafting process, since the first draft can be built around your actual documents rather than placeholders.

Affidavit vs. Declaration
| Point | Affidavit | Declaration |
| Nature | Sworn statement of facts | Written statement of facts |
| Oath | Usually required, before an authorised official | Not always required |
| Notary | Often required for attestation | Depends on the authority asking for it |
| Common use | Legal, official, and court-related matters | General self-declaration to an organisation |
The practical difference shows up at the point someone disputes the statement: an affidavit's sworn status gives the receiving authority a legal basis to treat a false statement as perjury, which is partly why institutions insist on an affidavit rather than accepting a simple declaration for anything with legal or financial consequence.
Affidavit Charges and Processing Time
What an affidavit costs comes down to three separate line items, not one fee:
Stamp Paper Value
Fixed by the state and varies by affidavit type and purpose. Denominations for a standard affidavit commonly range from around ₹10 to ₹100 under the Indian Stamp Act, 1899 and each state's own stamp schedule. Property-related or higher-value declarations often sit at the upper end.
Notary's Attestation Charge
Charged separately by the notary or attesting official.
The Drafting Service
The drafting itself.
Several states exempt affidavits made specifically for immediate use in a court proceeding from stamp duty altogether, so the correct figure genuinely depends on where and why the affidavit is being executed. Processing time is usually fast for the drafting itself; what can add time is collecting the right supporting documents and, in some states, booking the notary attestation step. Contact LegalDev for an exact quote and turnaround time for your specific affidavit type and state. Fixed pricing isn't quoted here since it varies by these factors.
Frequently Asked Questions
Got questions? Find clear answers from our legal team:
It's used wherever you need to formally prove a fact that no existing document covers on its own (a changed name, a current address, a lost certificate, a declared income, or a family relationship) by swearing to it before an authorised official.
The drafting itself can be done online: you share your details and receive a properly formatted draft. The attestation step, where a notary or magistrate administers the oath, still generally needs you to appear in person or, in some states, over a permitted video-call notarisation process, since the attesting official has to verify your identity and witness the signing.
For most purposes, yes. An unattested statement calling itself an affidavit carries little weight with banks, courts, or government offices. There are narrower exceptions: since 2017 reforms by the Ministry of External Affairs, several passport annexures now only need a self-declaration on plain paper, with no notary or magistrate attestation required, and more recent 2026 guidance has extended that relief to most minor passport applications, while affidavits for a lost or stolen passport and certain ECNR-related declarations still typically need a notary.
An affidavit swears to facts that have already happened or currently exist. An undertaking is a promise about future conduct: what the person signing commits to do or not do going forward. LLP closure filings commonly need both: an affidavit about the LLP's current state and an indemnity bond undertaking to cover any future claim.
Most affidavits don't carry a fixed expiry under the law itself; they stay valid as evidence of the facts stated at the time of signing. In practice, though, individual institutions often set their own freshness window. A bank or scholarship body may ask for an income affidavit executed within the last three to six months, so check the specific authority's requirement rather than assuming an older affidavit will be accepted.
Not by editing the signed document itself. If something in an already-notarised affidavit is wrong or needs updating, the usual route is drafting and executing a fresh, corrected affidavit, since altering a sworn document after attestation undermines the oath it was sworn under.
Yes. This is one of the most common affidavit types LegalDev drafts, typically prepared alongside the gazette notification step where the authority accepting the name change requires one.
Yes. LegalDev's LLP closure service includes preparing the affidavit and indemnity bond that Rule 37 of the LLP Rules, 2008 requires from designated partners before Form 24 can be filed, and the same documentation practice handles other company compliance affidavits as they come up.
It should be in a language the deponent and the attesting official both understand, and in the language the receiving authority accepts, commonly English or the relevant state's official language, with a certified translation sometimes required if the two differ.
Generally yes for the attestation itself, since a Notary Public's registration under the Notaries Act, 1952 is recognised nationally. But the stamp paper is state-specific, so an affidavit stamped in one state isn't automatically treated as correctly stamped if presented for a purpose in another state. Confirm locally if you're executing an affidavit for use across state lines.
Not automatically. Indian procedural law generally restricts affidavits to a supporting role unless a court specifically directs that a matter be proved by affidavit; a sworn statement alone doesn't substitute for oral testimony in most contested proceedings.
