Rent Agreement Drafting Services in India

Most rental disputes come down to a few lines nobody wrote down: how much of the deposit comes back, who pays for the geyser, how many days' notice ends the tenancy. A rent agreement puts those answers on paper before the keys change hands.

LegalDevIndia's rent agreement drafting services help landlords, tenants, property owners and businesses in India prepare agreements for homes, flats, shops and offices, or check one they have already been handed. To start, enquire about rent agreement drafting with the property location and the main terms you have agreed.

Key Takeaways

A rent agreement records the terms on which a landlord lets a tenant use a property: rent, deposit, duration, repairs, notice and handover.
Stamp duty, registration and tenancy rules depend on the state, the type of property and the length of the arrangement. The popular "11-month agreement" is a market habit, not a legal exemption that applies everywhere.
The Model Tenancy Act, 2021 is a template for states. It governs a tenancy only where a state has adopted it or passed a law on those lines.
LegalDevIndia drafts, reviews and amends residential and commercial rent agreements.

What Is a Rent Agreement?

A rent agreement is a written document in which a landlord allows a tenant to occupy or use a property in return for rent, on agreed terms. It normally names the parties, describes the property, states the rent and deposit, fixes the period and sets out who looks after what and how the arrangement ends.

How the law treats the document depends on what the arrangement really is, how long it runs and where the property is. The title on the first page does not decide that. A document headed "rent agreement" can legally be a lease, and a document headed "lease" can be a licence.

Why Is a Rent Agreement Important?

Payments, deposits and repairs are where tenancies go wrong, and memory is a poor record of any of them. A written agreement gives both sides something to point to if the rent is disputed, the deposit is held back or the tenant stays on after the period ends. It also gives the tenant proof of address and lawful occupation, which banks, employers and government offices often ask for.

Who Needs a Rent Agreement?

Landlords letting out a flat or house, tenants taking one, owners leasing shops and offices, and businesses that occupy premises all need one. A tenancy between relatives or friends is no exception, since informal arrangements are the ones most likely to be disputed later.

What Does a Rent Agreement Cover?

The main clauses are rent, security deposit, tenancy period, maintenance, notice, renewal, permitted use and termination. Each is covered below. The right set depends on the property and on what the parties have agreed.

Our Rent Agreement Drafting Services

The services below describe what we offer for rental documentation. We do not handle eviction suits or court appearances under this service unless separately agreed.

Residential Rent Agreement Drafting

For a house, flat or apartment, we record the rent, deposit, maintenance split, permitted occupants, house rules from the society where relevant and the notice terms. We also note any furniture and fittings so the condition at handover is not an argument later.

Commercial Rent Agreement Drafting

Shops, offices and other business premises raise extra points: the exact permitted business use, signage, access hours, who pays property tax, maintenance and utilities, fit-out rights and what must be removed at the end. Rent escalation and longer lock-ins are more common in commercial tenancies.

Existing Rent Agreement Review

We read an agreement you have received or drafted for unclear wording, one-sided clauses, a missing handover process or formalities that may be required in your state.

Renewal and Amendment

When the term ends or the parties change the rent, duration or deposit, we prepare a renewal or amendment so the paperwork keeps pace with the arrangement.

Stamping and Registration Assistance

Stamp duty and registration are state matters, and procedures differ.

What Should a Rent Agreement Include?

No single template suits every tenancy. The clauses below cover what most agreements need:

Landlord and Tenant Details
Full names, addresses and contact details. If the landlord is a company, a trust or joint owners, say so, and note if someone signs on the owner's behalf under a power of attorney.
Property Address and Description
The full address, floor, unit number, built-up area where known, parking or storage included and any boundaries that matter for a shop or an office. A vague description invites arguments over what was let.
Monthly Rent and Payment Terms
The amount, due date, mode of payment, bank details if rent is paid by transfer, and what happens on late payment. Keep late-payment charges reasonable, as courts do not enforce unreasonable ones, and keep records of every payment.
Security Deposit and Refund
The deposit amount, whether it earns interest, what may be deducted (unpaid rent, utility dues, damage beyond normal wear and tear) and when it is returned after handover. The clause should not allow the landlord to keep it without cause. States that follow the Model Tenancy Act's approach cap it, as covered in the legal section below.
Duration and Commencement Date
The start date, the term and what happens at its end: automatic expiry, renewal by fresh agreement or conversion to a month-to-month tenancy. Say clearly which one is intended.
Rent Escalation and Renewal
If rent will rise, write the percentage or formula and when it applies. Renewal should be by mutual written consent, and any statutory limits on rent increases in your state still apply.
Maintenance, Repairs and Utilities
Routine upkeep and minor repairs usually fall on the tenant, structural repairs on the landlord, and society charges, property tax, electricity and water according to what the parties agree. Name who pays the society charges and who holds the meter.
Lock-in and Notice Period
A lock-in means neither side can end the tenancy early without a stated consequence, often payment of rent for the balance period. Under Section 106 of the Transfer of Property Act, 1882, where the parties have not agreed otherwise, a month-to-month tenancy for non-agricultural, non-manufacturing purposes ends on 15 days' notice. The agreement can set its own terms, subject to state law.
Permitted Use
Whether the property is for residence, a named business or another use. A tenant who uses a flat as an office, or a shop for a different trade, breaches the agreement and may breach society or municipal rules too.
Damage and Alterations
Who bears the cost of damage the tenant causes, what changes the tenant may make with written permission and what must be restored at the end. Attach an inventory with the condition of fittings and appliances.
Subletting and Occupancy
Most landlords forbid subletting or assigning the premises and limit the number of occupants. State this plainly. Where state law protects certain occupants or sub-tenancies, the clause cannot remove those protections.
Landlord Access and Inspection
A landlord may need to inspect or repair, but the tenant is entitled to quiet enjoyment. Provide for reasonable notice, sensible hours and an exception for genuine emergencies.
Termination and Handover
How either side may terminate, what notice is needed, what counts as breach, how keys and possession are returned, how final utility bills are settled and when the deposit is refunded. Take a joint inspection with photographs at handover.
Dispute Resolution and Applicable Law
State that Indian law applies and name the courts or an arbitration route for disputes. A contract clause cannot take away rights that the law gives a tenant or a landlord, such as the right to approach a rent authority or court where the state law provides for one.

Types of Rent Agreements

The arrangement determines the paperwork. Common types:

Residential Rent Agreement

For houses, flats and apartments. Terms usually include rent, deposit, maintenance, occupants, pets or society rules, and a notice period.

Commercial Rent Agreement

For shops, offices, clinics and other business premises. It carries more detail on use, signage, access, fit-out, escalation and GST or tax treatment of rent.

11-Month Rent Agreement

A common period for residential tenancies in several cities. The reason is largely historical: under the Registration Act, 1908, a lease for more than one year, or one reserving a yearly rent, must be registered, so a shorter term at monthly rent was often left unregistered. That does not make every 11-month agreement exempt. Some states require tenancies or licences to be registered or reported whatever their length. Check your state.

Long-Term Lease Agreement

A lease for more than a year generally calls for registration, a higher stamp duty and a more detailed document covering rent revision, improvements and renewal. Commercial leases of three, five or nine years are common.

Furnished and Unfurnished Property Agreements

For a furnished property, attach a schedule listing every item, its condition and who bears repair or replacement. For an unfurnished property, record fittings such as lights, fans and cupboards.

The legal treatment follows the actual arrangement, not the heading on the document.

Rent Agreement vs Rental Agreement vs Lease Agreement

In everyday use, "rent agreement" and "rental agreement" mean the same thing, and we treat them as one on this page. "Lease" has a specific meaning in property law, so it matters more:

TermEveryday MeaningLegal Point
Rent agreement / rental agreementWritten terms for renting a propertyA label. The legal character depends on the arrangement
Lease agreementUsually a longer, more formal tenancySection 105 of the Transfer of Property Act, 1882 defines a lease as a transfer of the right to enjoy property for a term in return for rent or other consideration
Leave and licencePermission to occupy without a leaseGives a licence, not an interest in the property. Some states, such as Maharashtra, have specific rules for these
Rent vs Rental Agreement
None in substance. People use both for the same document. What counts is whether the clauses cover rent, deposit, period, repairs and exit clearly.
Rent vs Lease Agreement
A lease transfers an interest in the property for a term, with formal requirements including registration for leases of a year or more. A short rent agreement is often a lease in law too, just shorter and less formal. The difference is in duration, formalities, stamp duty and detail.
Which Suits Which Property
For a home, a residential rent agreement for 11 months or a year is common. For a shop or office, a longer lease with escalation and lock-in terms is typical. It depends on use, duration, state rules and the commercial deal.

Documents and Information Required for a Rent Agreement

The exact list depends on the property, the state and the scope of our engagement. Typically:

Clear and Structured Rental Clauses

Rent, deposit, maintenance, notice and handover each get their own clause, in plain language, so that landlord and tenant can find and follow them.

Transparent Service Scope

Before starting, we confirm what we will deliver, what we need from you and what government charges, such as stamp duty and registration fees, are separate.

Organized Documentation Support

You will know how to send your details, how drafts reach you and how the final document is delivered. We do not promise any legal outcome.

Frequently Asked Questions About Rent Agreements

Got questions? Find clear answers from our legal team:

It is a written contract between a landlord and a tenant that sets the rent, deposit, tenancy period, responsibilities and the way the tenancy ends.

No single central law makes a written rent agreement compulsory for every tenancy. But a lease of more than a year must be by a registered instrument, some states require written, registered or reported tenancies, and a written agreement is the best protection in any case.

No. Eleven months is a common practice in some markets, not a legal requirement. You can sign for a shorter or longer period, with the formalities that go with it.

It depends. Under the central Registration Act, a lease for a term of more than one year or reserving a yearly rent must be registered, so a plain 11-month lease at monthly rent often falls outside that rule. State laws can still require registration or reporting, and stamp duty applies regardless. Check your state.

Identification and address details of both parties, the property address, proof of ownership or authority to let, the agreed rent and deposit, the period and any inventory.

Sometimes. A lease is a legal term for a transfer of the right to enjoy property for a term, with formal requirements. A rent agreement is a general label that may describe a lease or a licence. The substance of the arrangement decides.

The parties can agree. State stamp laws often put the liability on a particular party by default, and in practice many agreements say the tenant pays or that it is shared. Check the rate and rule on your state's official portal.

Often the drafting, e-stamping and signing can be done online, depending on the provider and the state. A lease that must be registered still needs the registration steps.

Yes, by a fresh agreement or a written renewal on agreed terms, often with a rent increase. Check whether the new term triggers stamping or registration requirements.

The amount, whether interest is payable, the permitted deductions, the refund timeline and the handover inspection process. States that follow the Model Tenancy Act cap the deposit.

Yes, with additions: permitted business use, signage, access, fit-out, escalation, maintenance and tax treatment of rent.

Yes, by mutual written consent, following any amendment clause in the agreement. Check whether the change needs fresh stamping or registration.
