Name Change Services in India

A legal name change in India is completed through a notarised affidavit, a newspaper notice, and publication in the Gazette of India, Part IV, filed with the Department of Publication. But only the affidavit is always required; the newspaper notice and Gazette step apply mainly when you need strong, universally accepted proof for passports, banks, or employers. Gazette publication does not automatically update your other records.

If your name is spelled one way on your Aadhaar and another way on your marksheet, or you've added your husband's name after marriage and now your bank won't accept the mismatch, you're looking at a legal name change, not a simple correction form. This page covers the actual process for adults, minors, and post-marriage or post-divorce surname changes, what the Department of Publication's own guidelines require, and what updating Aadhaar, PAN, and passport after a Gazette entry actually involves.

A company name change is a different process entirely under the Companies Act, handled through the Ministry of Corporate Affairs. If that's what you're here for, this page isn't the one you need.

What Is a Legal Name Change?

A legal name change is the process of formally changing your name on record through a sworn affidavit and, where needed, public notice through a newspaper and the Gazette of India. There is no single statute in India that creates "the" name-change law. Instead, the process rests on the combination of a notarised declaration (the affidavit), public notice of the change, and, for the strongest form of proof, publication in Part IV of the Gazette of India by the Department of Publication, a subordinate office under the Ministry of Housing and Urban Affairs.

An affidavit alone is often enough for low-stakes updates, such as a school correcting a transcript or a minor administrative form. A Gazette entry matters more when a passport office, bank, employer, or land registry needs proof that will be accepted without further question, since the Gazette is a government publication rather than a private sworn statement.

When Do You Need to Change Your Name?

The right process depends on what actually changed: your entire name, just your surname, or only how it's spelled.

Full Name or First Name Change

Changing your given name entirely, for personal, religious, numerological, or other reasons. It follows the complete route: affidavit, newspaper notice, and Gazette of India Part IV publication for full legal recognition.

Surname Addition, Removal or Change

Adding a surname you never had, dropping one, or changing it outside a marriage or divorce context (adopting a family name, for instance) follows the same affidavit-and-Gazette route as a full name change, since the Department of Publication treats surname changes under its general change-of-name guidelines.

Name Change After Marriage or Divorce

Adopting a spouse's surname after marriage, or reverting to a maiden name after divorce, can usually be supported with the marriage certificate or divorce decree plus a supporting affidavit, without necessarily needing a fresh Gazette entry. Many banks and employers accept the marriage certificate or decree directly. A Gazette notification remains the stronger option if an authority specifically insists on it, and the Department of Publication does list a distinct fee for this category when filed.

Spelling Correction vs Legal Name Change

A spelling correction, such as fixing "Shreya" written as "Shriya" on one document, is handled under the Department's Public Notice category, not the Change of Name category, and carries its own fee. Filing the wrong category with the Department can get an application rejected outright.

Name Change Procedure in India

Five steps from deciding the category to updating your records:

1

Identify the Applicable Process

Decide which category genuinely applies: full name change, surname change, marriage/divorce-related change, minor's name change, or spelling correction. Each has its own Department of Publication guideline document and fee, so this decision shapes every step after it.

2

Prepare the Required Affidavit and Documents

Draft a notarised affidavit stating your old name, new name, father's or husband's name, and residential address, along with the specific supporting documents your category requires (covered below). The affidavit, like the rest of the file, should not be older than one year when submitted to the Department.

3

Newspaper Notice, Where Applicable

For a full name, surname, or minor's name change, the Department's own guidelines call for publication in one daily local leading newspaper stating the old name, new name, and father's or husband's name, with the original newspaper (not a cutting) submitted with the application. This step is specific to the Change of Name and Public Notice categories. It isn't a universal requirement for every kind of record update.

4

Gazette of India Publication, Where Applicable

Where you need the strongest form of proof, the file (affidavit, original newspaper, prescribed proforma, photographs, ID proof, and the fee receipt) goes to the Controller of Publications, Department of Publication, Civil Lines, Delhi 110054. The Department's guidelines are explicit that applications must be submitted personally or sent by post or courier. Agents, advocates, and other intermediaries are not an accepted channel for the submission itself, even though they can help prepare the paperwork beforehand.

5

Update Relevant Identity and Official Records

Once the Gazette entry (or affidavit and marriage/divorce document, where that's sufficient) is in hand, each institution (UIDAI for Aadhaar, the Income Tax Department for PAN, the passport office, your bank, and your educational institution) has its own separate update procedure and required proof. None of this happens automatically from the Gazette publication alone.

Documents Required for Name Change

The list depends on who is changing the name:

Adult Name Change

An original newspaper advertisement, a signed undertaking stating old and new name with father's or husband's name and address, the prescribed proforma typed and signed in duplicate with two witnesses, two self-attested passport photographs, self-attested ID proof, and the fee paid through Bharatkosh (the government's Non-Tax Receipt Portal), per the Department of Publication's adult guidelines.

Minor Name Change

Either parent can notify a minor's name change, submitting broadly the same category of documents (undertaking, newspaper notice, proforma, photographs, and ID proof) but naming the minor and the applying parent, with the Department's minor-specific fee applying instead of the adult one.

After Marriage or Divorce

A marriage certificate or a certified copy of the divorce decree, together with a supporting affidavit confirming the new name. Many receiving institutions accept this combination directly without a fresh Gazette filing, though some still ask for one, so check with the specific bank, employer, or office involved before assuming which route you need.

Gazette Name Change: Requirements and Process

The Gazette of India, Part IV is a weekly publication where the Department of Publication prints individual change-of-name notices, and it is the one document that virtually every authority in India accepts as conclusive proof of a legal name change. As of the Department's Office Order No. 761/O&M/2014-16 dated 19 September 2023, the government charges commonly cited by current practitioners are:

CategoryGovernment Fee
AdultRs. 1,100
MinorRs. 1,700
Name correction (Public Notice)Rs. 1,400

Paid through Bharatkosh. Confirm the exact figure there before paying, since these rates are revised periodically.

Physical printing of the Gazette stopped on 1 October 2015. You download your own copy free of charge from egazette.gov.in once it's published, and no further certification from the Department is needed for that downloaded copy to be valid.

Name Change for Minors

A parent, either the father or the mother, can notify a minor's name change with the Department of Publication, following broadly the adult process with the minor's details substituted throughout the affidavit, undertaking, and proforma. Where parents are separated or divorced, the Department maintains a distinct guideline specifically for public notice of a minor's name change following divorce, reflecting that consent and documentation requirements can differ from a straightforward family name change. The minor fee category applies regardless of which parent files.

How to Update Aadhaar, PAN, Passport and Other Records

A Gazette notification, or an affidavit plus marriage or divorce document where that's accepted, is supporting proof, not an automatic trigger, for updating your other records.

Aadhaar
Goes through UIDAI's own demographic-update process, either online or at an Aadhaar Seva Kendra, with the Gazette copy or affidavit submitted as proof of the new name.
PAN
Goes through the Income Tax Department's correction request process via the current PAN service provider.
Passport
Handled as a reissue application with the Ministry of External Affairs' Passport Seva system, which has its own list of acceptable proof documents.
Bank Records and Educational Certificates
Each follows the specific institution's own internal procedure.
Each of these moves at its own pace and on its own documentation list, so budget time separately for each update rather than assuming they happen together.

Name Change Service Process at LegalDev

LegalDev prepares the affidavit, undertaking, and prescribed proforma for your specific category (adult, minor, marriage or divorce related, or spelling correction), reviews your supporting documents against the Department of Publication's current guidelines, and advises on the newspaper notice wording and the correct government fee category before you submit. Because the Department's own rules restrict submission of the Gazette application to the applicant personally or by post, the final filing step with the Department of Publication remains something you, the applicant, carry out yourself. The service's role is getting every document right before that step, so the filing isn't rejected for an avoidable error.

Common Mistakes to Avoid

Most rejected files trip on one of these:

Filing a spelling correction under the Change of Name category instead of Public Notice, or the reverse, which the Department can reject as the wrong category
Submitting an affidavit or newspaper cutting instead of the original newspaper, when the guidelines call for the original
Assuming the Gazette entry automatically updates Aadhaar, PAN, passport, or bank records, and not budgeting separate time for each
Using documents older than the one-year age limit the Department applies to supporting paperwork
Trying to route the final Gazette submission through an agent or advocate, which the Department's guidelines do not accept as a valid channel
Skipping the newspaper notice for a category where it's actually required, which can stall the whole file

Frequently Asked Questions

Got questions? Find clear answers from our legal team:

No. Many routine updates go through with just a notarised affidavit, or a marriage certificate and affidavit for a post-marriage surname change. A Gazette entry becomes practically necessary when a specific authority (commonly a passport office, certain employers, or a land registry) insists on it as proof.

The Department processes applications and forwards them to the Government of India Press for printing. Practitioners commonly report a few weeks from a complete, correctly filed application to publication, though the Department does not publish a guaranteed timeline, and an incomplete file resets that clock.

The government fee is paid online through Bharatkosh, but the Department of Publication's own guidelines state that the application itself (documents, photographs, and ID proof) must be submitted in person or sent by post or courier. There is no stated online portal for the document submission itself at the central Department.

No. You still need to apply for a demographic update with UIDAI separately, using the Gazette copy or affidavit as your supporting proof.

A correction fixes an error, such as a misspelling carried over from one document to another, and falls under the Department's Public Notice category. A legal name change replaces the name itself and falls under the Change of Name category, with its own guideline and fee.

The Department's own adult guideline calls for one advertisement in a daily local leading newspaper. Some applicants additionally publish in a regional-language paper as a practical precaution, but this isn't stated as a mandatory second step in the official guideline itself.

Not the final submission itself. The Department's guidelines require the application to come from the applicant personally or by post, not through an agent or advocate. A service can prepare every document correctly so your own submission goes through cleanly.

Multiple prior changes generally need to be disclosed and may require additional supporting documents or a public notice filing rather than a straightforward change-of-name filing. Check with the Department or a legal professional about your specific history before filing.

Yes. It's a central government publication and is treated as valid proof across India, which is part of why it carries more weight than a locally notarised affidavit alone.

Yes. A surname-only change follows the same affidavit, newspaper, and Gazette route, filed under the same Change of Name guidelines, with only your surname stated as changing in the documentation.
