Provisional Patent Application in India: Process, Fees & Complete Guide
A provisional patent application is a first filing that fixes your priority date while the
invention is still being refined. In India you file Form 1 with a provisional
specification on Form 2. It grants no patent and no enforceable rights, and
under Section 9(1) of the Patents Act, 1970 you must file the complete specification within
12 months of the filing date, or the application is deemed abandoned.

Key takeaways
A provisional patent secures a date, not a patent. There is no grant on a provisional specification.
The 12-month deadline for the complete specification is fixed by the Act. Plan as if no extension exists.
Claims are not required in a provisional, but anything it fails to describe cannot later borrow its date.
The official fee is the Form 1 fee. On e-filing it is ₹1,600 for a natural person or startup, ₹4,000 for a small entity and ₹8,000 for others, as commonly published.
A provisional that is never followed up is not published, so it does not become public prior art through the Patent Office.
What is a Provisional Patent Application and Why File One?
"Provisional patent" is shorthand. The Act speaks of an application accompanied by a provisional
specification. Section 7(4) requires every ordinary application to carry either a provisional or
a complete specification, and Section 9 governs what follows.
The idea is simple. Inventions rarely arrive finished. A prototype is untested, a ratio is
unsettled, a software module is half built. You do not want a competitor to file while you
finish. A provisional specification lets you record what you have, today, and get a filing date
for it. You then have a year to complete the work and file the full document.
Is a provisional patent a real patent?
No, and this is the most common misunderstanding. A provisional application is never examined
and never granted. It cannot be enforced against anyone. Its only legal function is to give your
later complete specification an earlier priority date for whatever it fairly discloses. You may
describe your product as "patent applied for" while the application is pending. Never describe
it as "patented", because claiming a patent you do not hold carries penalties under the Act.
The 12-month rule
Section 9(1) requires the complete specification within twelve months from the date of filing.
If it is not filed, the application is deemed abandoned. The period runs from the earliest
provisional if you hold more than one. Put this date in your calendar the day you file, with
reminders at six, nine and eleven months.
Key Benefits of Filing a Provisional Patent Specification Early
An early date. If two people describe the same invention, the earlier filing date counts. A provisional gets you that date before the design is final.
Room to build. You can test the product, refine the process and show it to investors and pilot customers during the year, with a filing already on record.
Lower entry cost. The official outlay at filing is small, and no examination fee falls due yet.
Foreign filing base. The provisional date can anchor a Paris Convention or PCT filing made within 12 months. Indian residents must still respect Section 39, which requires an Indian filing first and a wait of six weeks without a secrecy direction, or the Controller's written permission, before applying abroad.
Quiet pending status. If the complete specification never follows, the provisional is not published by the Patent Office, so the Office itself does not put your description into public view.
Flexibility on what comes next. You may convert later. Section 9(4) lets the Controller, on request before grant, cancel the provisional and post-date the application to the date of the complete specification. Section 9(3) lets you treat a filed complete specification as a provisional if you ask within 12 months.
The benefit
depends entirely on drafting. A provisional that names only the headline idea protects only the
headline idea.
Difference Between Provisional Patent and Complete Patent Specification
A complete specification is the document that is published, examined and, if all goes well,
granted. A provisional specification is the earlier placeholder that backs its date.
|
Provisional specification |
Complete specification |
| Role |
Fixes the earliest date for what it discloses |
Defines the invention in legal terms and seeks the grant |
| Claims |
Not required |
Required; claims set the boundary of protection |
| Form |
Form 2, marked as provisional |
Form 2, marked as complete |
| Time limit |
The complete specification must follow within 12 months (Section 9(1)) |
Filed within that window, or directly at the start |
| Examination |
None |
Yes, after a request for examination |
| Publication |
Not published if no complete specification follows |
Published, normally 18 months from the earliest priority date |
| Rights it gives |
None you can enforce |
Enforceable rights once granted, for 20 years from filing |
| If you do nothing |
Deemed abandoned, and the date is lost |
Not applicable; examination must be requested in time |
| Strength depends on |
How fully it describes the invention and its variants |
Quality of claims and how well the description supports them |
The last row is the one to remember. Section 11(3A) gives a claim the earlier date only where it
is fairly based on matter disclosed in the earlier application. Matter you add later gets the
later date.

Step-by-Step Process to File Provisional Patent Online in India
From the first notes to the complete specification.
1
Write down the invention
Cover the problem, the solution, how it works, and every variant you can think of. Include sketches, flowcharts, parameters and ranges.
2
Search first
Check Indian and worldwide records through our patent search service so you know how close the prior art is.
3
Draft the provisional specification
Include the title, the technical field, background, the problem, a summary, a detailed description with embodiments, and drawings. Write more than you think you need. Claims are optional, but a statement of what you regard as the invention helps.
4
Settle the applicant details
Decide who the applicant is (individual, company, startup), who the inventors are, and how rights pass from inventors to applicant.
5
Prepare the forms
Form 1 and Form 2 are the core. See the next section for the rest.
6
File on the IP India e-filing portal
E-filing is cheaper than paper, and a digital signature certificate is normally needed.
7
Pay the fee online
Keep the filing receipt with your application number and date.
8
Docket the deadlines
Twelve months for the complete specification, and the later dates covered below.
9
Use the year
Build, test and write down every improvement. Keep dated lab notes.
10
File the complete specification before the twelve months end
Not on the last day. Plan to file in month ten or eleven.
Can I file a provisional patent myself?
Yes. Individuals and companies may file in their own name. The risk is thin drafting, since you
cannot add new matter to the original filing later. Many inventors draft their own disclosure and
have an attorney turn it into the specification.
How long does it take to file?
The filing itself is quick once the specification is ready. The time goes into the drafting. A
careful provisional for a technical invention takes real working sessions, not an afternoon.
Documents and Forms Required for Provisional Patent Filing
| Form or document |
Purpose |
| Form 1 |
The application for the patent |
| Form 2 |
The provisional specification |
| Form 3 |
Statement and undertaking under Section 8, giving details of corresponding foreign applications where relevant |
| Form 26 |
Authorisation of a patent agent, if one files for you |
| Form 28 |
Declaration to claim the lower fee as a startup or small entity |
| Proof of right |
Assignment or other evidence if the applicant is not the inventor |
| Priority document |
Only if you claim priority from an earlier foreign filing |
| Form 5 |
Declaration as to inventorship, which is due with the complete specification, not at the provisional stage |
Have these ready before you start: inventor names and addresses, applicant details, a clear
title, the specification text, and drawings in a clean file format. For each form, check the
current requirement on the portal before filing, because the Patent Office revises forms and
timelines.
Government Fees & Cost Breakdown for Provisional Patent
The official fee at the provisional stage is the Form 1 fee. These are the commonly published
e-filing rates after the 2024 amendments.

Paper filing costs about 10% more. Long specifications attract extra charges per page above the
standard count.
Notice what is not in the table. No examination fee is payable at the provisional stage. That
comes later, with the request for examination on Form 18, and it applies only to the complete
application. The same Form 1 fee does not need paying again when you file the complete
specification, though extra-page and extra-claim charges can apply to that document.
The larger cost is professional drafting. It varies with technical complexity, the number of
variants and drawings, and how much the team must learn about your field. Ask for a written
scope. Underspending here is the usual mistake, because a provisional that fails to support your
key claims wastes the filing fee and the year.
Confirm
every amount against the official IP India fee schedule before you pay, since schedules change.
What Happens After 12 Months of Provisional Patent Filing?
The year ends in one of three ways.
You file the complete specification in time
You submit it on Form 2, with claims, abstract and drawings. The declaration of inventorship on Form 5 goes in with it, or within a short permitted period. Claims fairly based on the provisional carry its date. Anything new carries the later date.
You file nothing
The application is deemed abandoned, and the provisional is treated as never filed. You lose the priority date. You may refile, but the clock starts again, and any disclosure you made in the meantime can count against you.
You go international
You can file under the PCT or in Paris Convention countries within the same 12-month window, claiming the provisional date. Remember Section 39 before filing abroad.
Here is the timeline that follows, counted from the provisional filing date as the earliest
priority date:
| Month |
Event |
| 0 |
Provisional application filed |
| By 12 |
Complete specification due; PCT or convention filings due |
| 18 |
Normal publication of the complete application, counted from the priority date |
| By 31 |
Request for examination, for applications filed on or after 15 March 2024 |
That 18-month publication point surprises people. Because publication counts from the priority
date, a complete specification filed at month 12 is published about six months later unless you
request early publication.
If you hold
several related provisionals, the 12 months run from the earliest one, so do not let a later
filing lull you into missing it.
