GST Late Fee Calculator: Calculate Late Fee for GSTR-1, GSTR-3B and Other Returns

LegalDev India Tax & Compliance Desk

A late GSTR-3B or GSTR-1 with tax liability costs ₹50 a day (₹25 CGST + ₹25 SGST), or ₹20 a day for a nil return, capped at ₹2,000, ₹5,000 or ₹10,000 depending on your turnover, under CBIC Notifications 19/2021-CT and 20/2021-CT. Interest of 18% per year under Section 50 applies separately, only on unpaid tax, from the day after the due date.

Miss a GST filing deadline by even a few days and two different charges start running at the same time: a fixed late fee that climbs daily until it hits a cap, and interest that only applies if you actually owe tax for that period. People mix these up constantly, and the mix-up usually costs them money, because a nil return still owes late fee even with zero interest, and a return with tax due owes both. Use the calculator below to get your exact numbers, or read on for the rates, caps, and a few recent developments most guides haven't caught up to yet.

What Is a GST Late Fee Calculator?

A GST late fee calculator works out the exact fee and interest owed on a delayed GST return by applying the per-day rate under Section 47 of the CGST Act, your return's applicable turnover cap, and 18% annual interest on any unpaid tax, so you get one final payable figure instead of working through three separate rules by hand. It takes your return type, due date, and actual filing date, applies the correct per-day rate and cap for that return, and splits the result into its CGST and SGST components the way the GST portal itself will when you pay.

Why Use a GST Late Fee Calculator?

You use one because the GST portal shows you the late fee only after you've already started filing, by which point you can't easily compare "file today" against "file in three days" to decide whether waiting changes anything meaningful. Working it out beforehand also catches a common and expensive mistake: assuming a nil return has no consequence for filing late, when it still accrues ₹20 a day up to ₹500. For anyone juggling multiple GSTINs or return types, a calculator turns a multi-step manual calculation into one lookup.

How to Use the GST Late Fee Calculator

1

Select the Return Type (GSTR-1, GSTR-3B, GSTR-9, etc.)

Different returns carry different per-day rates and caps, so this choice determines every number that follows.

2

Enter the Original Due Date

The statutory due date for your selected return and tax period — the 11th of the following month for monthly GSTR-1, the 20th for monthly GSTR-3B, or the relevant quarterly or annual date for other returns.

3

Enter the Actual Filing Date

The date you filed, or plan to file, the return. The calculator counts every day between the day after the due date and this date.

4

Select Your Annual Turnover Slab

Your aggregate turnover in the preceding financial year determines which cap applies — up to ₹1.5 crore, ₹1.5 to ₹5 crore, or above ₹5 crore for GSTR-3B and GSTR-1.

5

Enter Outstanding Tax Amount (for Interest Calculation)

If there's unpaid tax for the period, enter it here so the calculator can work out interest at 18% per annum under Section 50, separate from the late fee itself.

6

View Late Fee, Interest and Total Payable

The result breaks down into days of delay, late fee per day, total late fee, the CGST and SGST shares, interest (if applicable), and the total amount payable.

Mathematical Formulas & Statutory Rules

1. Section 47 Late Fee Formula

Calculated Fee = Days Delayed × Daily Rate
Payable Fee = Min(Calculated Fee, Turnover Cap)
CGST Fee = Payable Fee / 2
SGST Fee = Payable Fee / 2

Daily Rates:
• Regular: ₹50/day (₹25 CGST + ₹25 SGST)
• Nil Return: ₹20/day (₹10 CGST + ₹10 SGST)

2. Section 50(1) Penal Interest Formula

Interest = (Net Cash Tax × 18 × Days Delayed) / (100 × 365)

Key Statutory Condition:
Per the retrospective amendment to Section 50(1), interest applies only on the net cash liability paid via Electronic Cash Ledger. No interest is charged on the ITC portion.

GST Late Fee Rates: Return-Wise

GSTR-1 Late Fee ₹50 a day (₹25 CGST + ₹25 SGST) for a return with outward supplies, ₹20 a day for a nil return, capped at ₹2,000 to ₹10,000 by turnover, under Notification 20/2021-Central Tax. GSTR-1 carries no interest of its own, since no tax is paid through it directly.
GSTR-3B Late Fee ₹50 a day (₹25 CGST + ₹25 SGST) for a regular return, ₹20 a day for nil, capped the same way as GSTR-1, under Notification 19/2021-Central Tax. Interest at 18% per annum applies on top of this if tax remains unpaid past the due date.
GSTR-9 Late Fee Graded by turnover under Notification 07/2023-Central Tax: ₹50 a day for turnover up to ₹5 crore, ₹100 a day for ₹5 to ₹20 crore, and ₹200 a day above ₹20 crore, each capped at a percentage of turnover in the relevant state (0.04% for the lower two tiers, 0.25% under each Act — 0.5% combined — for the top tier). GSTR-9 itself is optional, with no late fee, for taxpayers with turnover up to ₹2 crore.
GSTR-4 Late Fee ₹50 a day (₹25 CGST + ₹25 SGST) for composition taxpayers filing their annual return late, capped at ₹2,000, or ₹20 a day capped at ₹500 for a nil return.
CMP-08 Late Fee CMP-08 is the composition scheme's quarterly tax payment statement rather than a return in the Section 47 sense, so the standard per-day late fee structure doesn't apply to it the same way it does to GSTR-4 — practitioners and the portal itself have treated this inconsistently across periods. What's certain is that interest under Section 50 still runs on any tax paid late through CMP-08.

Statutory Maximum Capping Slabs (CBIC Relief)

To alleviate the burden on micro, small, and medium enterprises (MSMEs), the GST Council rationalized late fees vide Notification No. 19/2021 - Central Tax, placing permanent upper ceilings based on turnover:

Taxpayer Class / Turnover Slab Daily Rate (CGST + SGST) CGST Cap SGST Cap Total Maximum Cap
Nil Tax Liability Returns ₹20 / day (₹10 + ₹10) ₹250 ₹250 ₹500
Annual Turnover up to ₹1.5 Crore ₹50 / day (₹25 + ₹25) ₹1,000 ₹1,000 ₹2,000
Turnover between ₹1.5 Cr and ₹5 Crore ₹50 / day (₹25 + ₹25) ₹2,500 ₹2,500 ₹5,000
Annual Turnover Above ₹5 Crore ₹50 / day (₹25 + ₹25) ₹5,000 ₹5,000 ₹10,000

GST Late Fee vs GST Interest: What's the Difference?

Late fee is a fixed daily charge for filing the return itself late, capped by turnover, and applies even to a return with zero tax due. Interest is a percentage charge, uncapped, that applies only when tax payment itself is late, calculated on the unpaid cash portion at 18% per year from the day after the due date. A nil return can owe late fee with no interest; a return with full tax paid on time but filed a day late owes late fee with no interest; a return filed late with tax still outstanding owes both.

GST Late Fee Calculator Examples

Example 1: GSTR-3B Filed 10 Days Late (Turnover ₹2 Crore) Late fee = 10 days × ₹50 = ₹500 (₹250 CGST + ₹250 SGST), well under the ₹5,000 cap for the ₹1.5–5 crore turnover band.
Example 2: Nil GSTR-1 Filed 15 Days Late Late fee = 15 days × ₹20 = ₹300 (₹150 CGST + ₹150 SGST), under the ₹500 nil cap.
Example 3: GSTR-3B Filed 30 Days Late with Outstanding Tax Turnover under ₹1.5 crore, ₹1,00,000 tax outstanding. Late fee = 30 × ₹50 = ₹1,500 (under the ₹2,000 cap). Interest = ₹1,00,000 × 18% × (30 ÷ 365) ≈ ₹1,479. Total payable ≈ ₹1,00,000 tax + ₹1,500 late fee + ₹1,479 interest = ₹1,02,979.
Example 4: GSTR-9 Filed 60 Days Late Turnover ₹8 crore, so ₹100 a day applies. Late fee = 60 × ₹100 = ₹6,000. The 0.04% turnover cap works out to ₹32,000, well above ₹6,000, so the full ₹6,000 (₹3,000 CGST + ₹3,000 SGST) is payable.

GST Late Fee Waiver and Amnesty Schemes

As of October 2026, there's no blanket GST late fee waiver in force — the most recent broad relief, under Section 128A for interest and penalty on past demands, required payment by 31 March 2025 and has since closed. What's genuinely new, and not yet in effect: the GST Council's 57th meeting has recommended that small taxpayers with turnover up to ₹5 crore pay zero late fee on a delayed GSTR-3B if they file it by the end of the same month it was due, but this is a Council recommendation, not yet a notified rule — the existing late fee structure described on this page still applies until CBIC issues the formal notification. CBIC periodically notifies late fee waivers. Check the latest notifications on cbic-gst.gov.in before assuming a waiver applies to your situation.

What Happens If You Don't Pay GST Late Fee?

An unpaid late fee sits as an outstanding liability on your electronic liability ledger and blocks filing of your next return for that GSTIN until it's cleared, since the GST portal requires each period's dues settled before accepting the next period's return. Left unresolved for long enough, continued non-filing can lead to notice, assessment, or eventual cancellation of registration for persistent default, separate from the late fee itself.

How GSTR-1 Late Fee Affects Your Next GSTR-3B

A late GSTR-1 doesn't block your own GSTR-3B for the same period, but it delays your buyers' input tax credit, since their GSTR-2B statement draws directly from what you've reported in GSTR-1. The rule that does create a direct block runs the other way: under Rule 59(6) of the CGST Rules, you can't file GSTR-1 for a new period if you haven't filed GSTR-3B for the preceding tax period, so an unfiled GSTR-3B is what actually stops your filing chain, not the reverse.

Common Mistakes While Calculating GST Late Fee

  • Assuming a nil return has no late fee, when it still accrues ₹20 a day up to ₹500
  • Applying interest on the full tax liability instead of only the net amount paid in cash, which overstates what's actually owed since the 2021 Section 50 amendment
  • Using the wrong turnover band because last year's turnover, not this year's, is what sets the cap
  • Forgetting that GSTR-1 and GSTR-3B are calculated and capped separately, even for the same tax period
  • Assuming a rumoured or Council-level waiver already applies before CBIC has actually notified it

Who Should Use a GST Late Fee Calculator?

Small Business Owners - checking the exact cost of a delay before deciding whether to rush a filing or absorb a short delay.
Freelancers and Service Providers - working out the fee on an occasional late GSTR-3B, particularly during a month with cash flow pressure.
Accountants and Tax Professionals - quoting clients an accurate number quickly across multiple GSTINs and return types, rather than calculating each by hand.
E-commerce Sellers - tracking late fee exposure across GSTINs registered in several states, where turnover bands and filing dates can differ by state.
Composition Scheme Taxpayers - working out GSTR-4 and CMP-08 exposure separately, since the composition scheme's late fee treatment differs from the regular scheme's.
This GST late fee calculator is for general guidance only. Actual late fee and interest may vary based on CBIC notifications, return type, and turnover. Verify on the official GST portal before payment.

GST Late Fee Calculator: FAQs

₹50 for a regular GSTR-3B or GSTR-1 (₹25 CGST + ₹25 SGST), or ₹20 for a nil return, starting the day immediately after the due date.
Yes — ₹20 a day, capped at ₹500, even with zero tax liability for the period.
₹10,000 for a regular GSTR-3B or GSTR-1 at the highest turnover tier, or 0.5% of state turnover combined for GSTR-9 above the ₹20 crore band — there's no fixed maximum for GSTR-9 at that tier since it scales with turnover.
Yes — the per-day rate and the cap both split evenly between CGST and SGST, and you pay each component separately through the portal.
Yes, if tax remains unpaid. Interest at 18% per annum runs on the unpaid cash tax amount, calculated separately from and in addition to the fixed late fee.
Outstanding tax × 18% × (days late ÷ 365), applied only to tax actually paid in cash rather than offset through available input tax credit.
No blanket waiver is currently notified. The GST Council has recommended a zero-late-fee window for small taxpayers filing a delayed GSTR-3B within the same month, but this requires a formal CBIC notification before it takes effect.
Not directly — the block runs the other way: an unfiled GSTR-3B for the preceding period stops you from filing your next GSTR-1 under Rule 59(6) of the CGST Rules.
Your aggregate turnover in the preceding financial year, not the current year's figure, sets which cap band applies.
No — it's graded by turnover (₹50, ₹100, or ₹200 a day depending on the band), and businesses with turnover up to ₹2 crore aren't required to file GSTR-9 at all, so no late fee applies to them for it.
No — the GST return filing system doesn't support revising a filed return in that way, and misreporting a return as nil when it isn't creates its own compliance risk separate from the late fee question.
Yes, the portal calculates and displays the applicable late fee at the time of filing, which this calculator is designed to let you preview beforehand.
